The DMV, or “Department of Motor Vehicles,” is often the generic term used for the agency that enforced driver license laws in a State.  The agency responsible for administering driver license laws in Colorado is the Colorado Department of Revenue, Division of Motor Vehicles.  The agency responsible for administering registration and car title laws in Colorado is also the Colorado Department of Revenue, Division of Motor Vehicles.

1.    What agency in Colorado provides driver licenses?

In Colorado, you can obtain a driver’s license from the Colorado Department of Revenue, Division of Motor Vehicles.

2.    What are the age requirements for getting an Colorado driver’s permit or driver’s license (noncommercial)?

If you are under 18, there are three types of permits available to minors:
  • Driver Education Permit: Available to 15 years -15 years and 6 months
  • Driver Awareness Permit: Available to 15 years and 6 months – 16 years
  • Minor Instruction Permit: Available to 16 years – 21 years
    
A driver’s license is available to you if you are:
  • 18 years old, or
  • under 18, but at least 16 years old, and have held a Minor Instruction Permit for at least 12 months


3.    What are the restrictions for an Colorado driver’s permit or driver’s license?

DRIVER EDUCATION PERMIT

With a Colorado Driver Education permit, the driver is permitted to drive only with his or her driver education (driver ed) instructor or the person(s) who signed the DR2460 form (or a designated “Alternate Permit Supervevisor”) until the age of 18.  At age 18, the person with a driver education permit may drive with any Colorado-licensed driver who is 21 years of age or older. At 18, the person with the Colorado Driver Education Permit may driver with any person who has a Colorado driver’s license who is 21 years or older.

DRIVER AWARENESS PERMIT

With a Colorado Driver Awareness Permit, the driver may drive only with the person who signed his or her DR2460 form (or a designated “Alternate Permit Supervisor”) until the age of 18. At 18, the person with the Colorado Driver Awareness Permit may driver with any person who has a Colorado driver’s license who is 21 years or older.

MINOR INSTRUCTION PERMIT

With a Colorado Minor Instruction Permit, the driver may drive only with the person who signed his or her DR2460 form (or a designated “Alternate Permit Supervisor”) until age 18.  At 18, the person with the Colorado Minor Instruction Permit may driver with any person who has a Colorado driver’s license who is 21 years or older.

Additional General Restrictions for Colorado Drivers
  • If you are less than 18 years of age, you are not permitted to drive a vehicle with a passenger who is under 21 years of age unless you have been in possession of a Colorado Driver’s License for at least 6 months
  • If you are less than 18 years of age, you are not permitted to drive a vehicle with more than one passenger who is less than 21 years of age unless you have been in possession of a Colorado Driver’s License for at least one year

EXCEPTIONS TO ABOVE TWO RESTRICTIONS

  • If (a) your parent/guardian is a passenger, (b) there is a passenger who is 21 years of age or older who possesses a valid Driver’s License and has done so for at least a year, (c) your passenger who is under the age of 21 needs emergency medical care, or (d) your passengers under 21 years of age are immediate family members and they are all wearing seatbelts
  • If you are less than 18 years of age, you are not permitted to driver between midnight and 5 a.m., unless (a) you have been in possession of your Driver’s License for at least a year, (b) your parent/guardian is a passenger, (c) there is a passenger who is at least 21 years of age who holds a valid Driver’s License and has done so for at least one year, (d) you are driving to a school-authorized activity (with a signed statement from school official verifying) or school and there is no school-provided transportation available, (e) you are driving due to employment, and are carrying a signed statement from an employer verifying employment, or (f) you are driving due to an emergency, or (g) you are a minor who has been emancipated, but your parent(s)/guardian(s) have not had your driver’s license canceled.

4.    What documents must I present to the Colorado DMV to obtain a Colorado driver’s permit or driver’s license?

DRIVER EDUCATION PERMIT
   
To obtain a Colorado Driver Education Permit, you must present the following to the following to the Colorado Department of Revenue, Division of Motor Vehicles:
  • Affidavit of Liability and Guardianship, completed, signed by a parent or stepparent, a guardian or a grandparent with Power of Attorney
  • Completed Affidavit of Completion of a Driver Education Course or BTW demonstrating completion of the classroom part of a department-approved Colorado Driver Education Course within 6 months before applying for the Colorado Driver Education Permit.

DRIVER AWARENESS PERMIT

To obtain a Colorado Driver Awareness Permit, you must present the following to the following to the Colorado Department of Revenue, Division of Motor Vehicles:
  • Affidavit of Liability and Guardianship, completed, signed by a parent or stepparent, a guardian or a grandparent with Power of Attorney
  • Documentation showing completion of a department-approved 4-hour driver awareness program

MINOR INSTRUCTION PERMIT
  • Affidavit of Liability and Guardianship, completed, signed by a parent or stepparent, a guardian or a grandparent with Power of Attorney
  • Certified Birth Certificate (or other form of acceptable ID)

NOTE REGARDING AFFIDAVIT OF LIABILITY AND GUARDIANSHIP

For all of the above, if the signer of the Affidavit of Liability and Guardianship is a guardian, you must also present to the Colorado DMV original court documents showing guardianship, custody or adoption. If the signer is a grandparent with Power of Attorney, you must present the original Power of Attorney and you must surrender a copy of the Power of Attorney when applying for the permit. If neither parent is living, the legal guardian of the minor may sign the affidavit. In this case, court-ordered guardianship papers are required.

In order to obtain a Colorado learner's permit or driver's licenset or an instruction permit, you must complete a written test and a vision screening test
